1. Parties

1.1. The Service Provider: Culture Collective Services, providing photography, videography, content creation, editing, and related production services.

1.2. Consumer: An individual or entity receiving services from the Service Provider.

1.3. Third Party: An individual or entity that does not form part of the Service Provider or Consumer.

2. Services and Payment

2.1. The quotation will be valid for 14 days, subject to changes at the discretion of the Service Provider.

2.2. A 50% deposit is required upon acceptance of the quotation unless otherwise stated on the quotation. No services will be rendered until proof of payment has been received and cleared.

2.3. No service delivery will commence, nor costs incurred, prior to written acceptance of the quotation.

2.4. The Consumer acknowledges that all deliverables are based on the scope outlined in the accepted quotation.

2.5. Any additions, amendments, or scope changes requested by the Consumer after acceptance of the quotation may incur additional costs and must be approved in writing before commencement.

2.6. The quoted fee includes two (2) rounds of revisions on the final edited content.

2.7. Any revisions requested after the third revision round will be charged at an hourly editing rate of R850 per hour.

2.8. Changes requested after final approval, sign-off, or delivery will be charged separately at R850 per hour.

2.9. Urgent editing requests required outside normal business hours may incur an after-hours rate of R850 per hour.

2.10. Payment must be made in full within 30 days of invoice unless otherwise agreed in writing.

2.11. The Service Provider reserves the right to withhold delivery of final content until all outstanding amounts have been settled in full.

2.12. Payments due and in default will be subject to interest at the prevailing repo-linked rate.

2.13. Delivery timelines are estimates and may be affected by revision requests, project complexity, client delays, weather conditions, or circumstances beyond the Service Provider’s control.

3. Creative Direction and Production

3.1. The Service Provider will make every reasonable effort to understand the Consumer’s vision prior to the shoot.

3.2. The Consumer is responsible for communicating all required deliverables, shot lists, content requirements, branding requirements, references, and expectations before the scheduled shoot date.

3.3. Any specific photo, video, content, or editing requests must be communicated prior to the shoot and editing process.

3.4. The Service Provider cannot guarantee the capture of content that was not discussed, briefed, or agreed upon before the shoot.

3.5. Additional content requests made during the shoot may not be accommodated due to time, logistical, or production constraints.

3.6. The Consumer acknowledges that the Service Provider’s editing style, colour grading, composition, storytelling approach, and creative direction form part of the service offering and are clearly represented throughout the Service Provider’s portfolio and previous work.

3.7. By engaging the Service Provider, the Consumer accepts and acknowledges the Service Provider’s creative style and artistic interpretation.

4. Editing and Deliverables

4.1. Final deliverables will be edited according to the Service Provider’s professional standards and creative discretion.

4.2. RAW photographs, RAW video footage, project files, editing timelines, Adobe project files, source files, and unedited content remain the exclusive property of the Service Provider.

4.3. RAW photographs and RAW video footage will not be distributed, supplied, transferred, or sold unless specifically agreed to in writing and quoted separately.

4.4. The Service Provider is not obligated to provide unused footage, alternative edits, rejected images, or unedited content.

5. Retouching

5.1. Standard post-production includes colour correction, exposure correction, cropping, and general image enhancements.

5.2. Retouching is not included unless specifically quoted.

5.3. Retouching includes but is not limited to:

• Object removal

• Skin retouching

• Background replacement

• Extensive clean-up work

• Composite imagery

• Body modifications

• Product manipulation

5.4. Retouching requests will be quoted separately and charged in addition to the agreed project fee.

5.5. The Service Provider prioritises authentic and natural imagery and does not include extensive retouching within standard editing services.

6. Travel and Production Expenses

6.1. Travel will be charged at R8.00 per kilometre unless otherwise stated in the quotation.

6.2. Travel is calculated from the Service Provider’s office location to the shoot location and return.

6.3. Accommodation, flights, parking fees, toll fees, permits, venue fees, and other travel-related expenses may be charged separately where applicable.

7. Retainer Services

7.1. Retainer clients will receive services as outlined in their accepted quotation or service agreement.

7.2. Any unused shoot hours, content allocations, revisions, or deliverables do not roll over to subsequent months unless otherwise stated in writing.

7.3. Additional work requested outside the agreed retainer scope may be quoted and billed separately.

8. Cancellation and Rescheduling

8.1. Deposits are non-refundable.

8.2. Should the Consumer postpone or reschedule a shoot, the Service Provider will make reasonable efforts to accommodate a new date subject to availability.

8.3. Rescheduling within 48 hours of the scheduled shoot date may incur additional costs.

8.4. Should the Consumer cancel a booked shoot after confirmation, any costs already incurred by the Service Provider will remain payable.

9. Copyright and Usage Rights

9.1. All photographs, videos, and content remain the intellectual property and copyright of the Service Provider unless otherwise agreed in writing.

9.2. Upon full payment, the Consumer receives a licence to use the final delivered content for its intended business and marketing purposes.

9.3. The Consumer may not sell, transfer, licence, alter, or distribute the content to third parties for commercial resale without written consent.

9.4. The Service Provider reserves the right to use completed work for marketing, social media, portfolio purposes, award submissions, case studies, and promotional activities unless otherwise agreed in writing.

10. Limitation of Liability

10.1. The Service Provider shall not be liable for any indirect, consequential, or financial losses suffered by the Consumer.

10.2. Liability shall be limited to the total amount paid by the Consumer for the services rendered.

10.3. The Service Provider shall not be held liable for circumstances beyond its reasonable control, including but not limited to weather conditions, venue restrictions, equipment failure, illness, acts of God, power outages, or third-party failures.

11. Protection of Personal Information

11.1. The Consumer consents to the processing of personal information for purposes related to service delivery in accordance with the Protection of Personal Information Act (POPIA).

11.2. The Service Provider undertakes to keep all personal information confidential and secure in accordance with applicable legislation.

12. Acceptance

12.1. By accepting a quotation, paying a deposit, booking a shoot, or making use of the Service Provider’s services, the Consumer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
